BatchNav, Inc. (“Provider”) respects the privacy of its Customers, Users, and other third-party users and is committed to protecting that privacy through compliance with the terms of this Privacy Policy. This Privacy Policy describes the types of information Provider may collect from Customers or that Customers may provide when Customers or their Users visit Provider’s website, interact with Provider’s advertising or applications on third-party websites or services (as applicable), or otherwise utilize Provider’s services (collectively, the “Services”). It also explains Provider’s practices for collecting, using, maintaining, protecting, and disclosing such information. This Privacy Policy applies to information collected through the Services, through Customers’ or Users’ use of any Provider website, and through email, text, or other electronic communications between the parties.

State Privacy Rights

Certain state consumer privacy laws may provide residents with additional rights regarding Provider’s use of their Personal Information. Residents of California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Montana, Oregon, Tennessee, Texas, Utah, and Virginia may have the right to confirm whether Provider processes their Personal Information, access and delete certain Personal Information, correct inaccuracies in their Personal Information (except where excluded by state law), obtain a portable copy of their data, opt out of certain personal data processing activities such as targeted advertising, sales, or profiling, and limit, opt out of, or require consent for the processing of sensitive personal data. The scope of these rights may vary by state.

To exercise any applicable rights, Customers and Users may request additional information by contacting Provider at its Support E-Mail. Customers and Users may also appeal decisions regarding consumer rights requests by submitting an appeal through the same Support E-Mail. Nevada residents have a limited right to opt out of certain Personal Information sales. Requests to exercise this right may be submitted to Provider’s Support E-Mail, although Provider does not currently sell Personal Information in a manner that triggers Nevada’s opt-out requirements.

Children’s Use

Provider’s Services are not intended for individuals under eighteen (18) years of age. Provider does not knowingly collect Personal Information from children under 18. Individuals under 18 should not use Provider’s Services, register for subscription services, make purchases, use interactive or public features, or provide any personal information to Provider, including names, addresses, telephone numbers, email addresses, or online usernames.

If Provider learns that it has collected or received Personal Information from a child under 18 without verified parental consent, Provider will delete that information. If a Customer or User believes Provider may have information from or about a child under 18, they should contact Provider at support@batchnav.com. California residents under 16 years of age may have additional rights regarding the collection and sale of their Personal Information.

Information Provider Collects and How It Is Collected

Provider collects several types of information from and about Customers and Users, including Personal Information that can identify an individual, information that does not directly identify an individual but relates to usage or general location, data regarding how Services are used, and technical information about internet connections, devices, and browsing behavior. This information may be collected directly from Customers or Users, automatically as they navigate or use the Services, or from third parties such as business partners.

Information collected directly from Customers or Users may include information submitted through forms, registrations, subscriptions, correspondence, surveys, transactions, payment processing, search queries, and requests for support services. Customers and Users may also submit content to public areas of Provider’s website or Services, referred to as “User Contributions.” These contributions are shared at the user’s own risk. While Provider may restrict access to certain areas, no security measures are completely secure, and Provider cannot guarantee that User Contributions will not be accessed by unauthorized individuals.

Provider also uses automatic data collection technologies to gather information about Customers’ and Users’ equipment, browsing actions, and usage patterns. This may include traffic data, logs, location data, IP addresses, operating systems, and browser types. Such information may be combined with Personal Information obtained through other means. These technologies help Provider improve Services, understand usage patterns, store user preferences, enhance search functionality, and recognize returning users.

Automatic data collection technologies used by Provider may include cookies, web beacons, and flash cookies. Cookies are small files placed on a device that help track usage and preferences. Web beacons are small electronic files used to count visits and analyze performance. Flash cookies store information locally and are managed separately from standard browser cookie settings. Users may control cookies through browser settings, though disabling cookies may limit access to certain Services.

Third-Party Tracking Technologies

Some content or portions of Provider’s Services and website may be delivered by third parties, including service providers, advertisers, ad networks, and application providers. These third parties may use cookies, web beacons, or other tracking technologies to collect information about Customers’ and Users’ online activities over time and across different websites. This information may be used to deliver interest-based or targeted advertising. Provider does not control these third-party technologies or their use of collected information. Questions regarding targeted content should be directed to the applicable third party.

How Provider Uses Information

Provider uses the information it collects to provide and operate the Services, deliver requested content and support, fulfill contractual obligations, process billing and payments, communicate changes or updates, enable interactive features, and carry out other purposes disclosed at the time information is provided. Provider may also use information to contact Customers and Users about products or services offered by Provider or third parties that may be of interest.

Provider may use collected information to help advertisers reach target audiences. While Provider does not disclose Personal Information for advertising purposes without consent, interactions with advertisements may allow advertisers to infer that a Customer or User meets certain targeting criteria.

Disclosure of Information

Provider may disclose aggregated or non-identifying information without restriction. Personal Information may be disclosed to affiliates, subsidiaries, service providers, contractors, or other third parties supporting Provider’s business operations. Provider may also disclose Personal Information in connection with mergers, asset transfers, restructurings, bankruptcy proceedings, or similar events.

Additional disclosures may occur to fulfill the purpose for which information was provided, with user consent, to comply with legal obligations or government requests, to enforce agreements, or to protect the rights, property, or safety of Provider, its Customers, Users, or others. This may include sharing information for fraud prevention or credit risk reduction.

Choices Regarding Personal Information

Provider seeks to provide Customers and Users with meaningful choices regarding the use of their Personal Information. Users may control cookie preferences through browser settings, though disabling cookies may affect Service functionality. Location information collection may be managed through device privacy settings, and restricting location access may limit certain features.

Customers and Users who do not wish Provider to share Personal Information with unaffiliated third parties for promotional purposes may opt out at the point of data collection or by contacting Provider’s Support E-Mail. Provider does not control third-party advertising practices, but many advertising networks offer opt-out mechanisms, including through the Network Advertising Initiative.

Accessing and Correcting Information

Customers and Users may review and update their Personal Information by logging into their accounts or accessing profile settings within the Services. Deleted User Contributions may remain visible in cached or archived locations or may have been retained by other users.

Data Security

Provider has implemented security measures designed to protect Personal Information from unauthorized access, loss, misuse, or disclosure. Customers and Users are responsible for maintaining the confidentiality of their login credentials and should avoid sharing sensitive information in public areas of the Services. While Provider takes reasonable steps to protect data, no transmission over the internet is completely secure. Any transmission of Personal Information is at the user’s own risk, and Provider cannot guarantee absolute security.

Changes to This Privacy Policy

Provider reserves the right to modify this Privacy Policy at any time. Updates will be reflected by revising the “Last Updated” date and posting the updated policy on the Services or related websites. Continued use of the Services after changes are posted constitutes acceptance of the revised policy, which supersedes all prior versions.
